Unreasonable Refusal Defense in Virginia

Virginia DUI Law Authors Defending Post-Arrest Test Refusals

Our attorneys were selected by Thomson Reuters Westlaw to author a book on Virginia DUI law. That work directly informs how we review an unreasonable refusal charge and its relationship to the underlying DUI case.

Refusing a post-arrest breath or blood test can lead to a separate charge and affect your driving privileges, even if the DUI allegation has a different outcome. One of the first questions is which test was declined because Virginia treats an optional roadside breath test differently from evidentiary testing requested after an arrest.

Call (757) 568-7978 to have our attorneys review the test request, refusal allegation, and potential license consequences.

How Virginia Implied Consent Applies After an Arrest

Virginia implied consent law generally applies when a person operates a motor vehicle on a highway and is arrested for a qualifying DUI-related offense within three hours of the alleged offense. Under this law, driving constitutes consent to chemical testing after a qualifying arrest.

For an alcohol-related arrest, the required test is generally a post-arrest evidentiary breath test. Blood chemical testing may be used when breath testing is unavailable or the person is physically unable to provide a breath sample.

A preliminary breath test offered before arrest under Virginia Code § 18.2-267 is optional. Declining that roadside screening isn’t the same as refusing a required post-arrest test. Virginia Code § 18.2-268.3 governs whether a person unreasonably refused the required breath or blood sample after arrest.

Penalties for a Virginia Refusal Charge

A first unreasonable refusal involving a breath or blood test is a civil offense carrying a one-year driver’s license suspension. This suspension is separate from and may be added to any license consequences resulting from a DUI conviction.

A qualifying subsequent refusal of a breath test within 10 years can be prosecuted as a Class 1 misdemeanor. A conviction can result in a three-year revocation of driving privileges, depending on the facts and applicable law.

Restricted Driving Privileges

A person found guilty of a first refusal may petition the court for a restricted driver’s license under current Virginia law. Approval isn’t automatic. Statutory eligibility, court authorization, ignition interlock requirements, and other conditions determine whether and how restricted privileges may be granted.

Commercial drivers need guidance specific to their licenses. Restricted driving provisions don’t eliminate any separate disqualification that applies to a commercial driver’s license.

Issues That Can Shape an Unreasonable Refusal Defense

A refusal charge requires more than proof that a requested test wasn’t completed. We examine whether the statutory requirements were met and what the evidence reveals about the request and response.

Our review may address:

  • The arrest: Whether there was a qualifying arrest, the alleged operation occurred on a highway, and the arrest happened within the statutory period.
  • The advisement: Whether the officer gave the required refusal advisement and accurately documented the response.
  • The alleged refusal: Whether the response was unequivocal or involved a claimed inability, medical condition, communication problem, or disputed exchange.
  • The testing procedure: Whether the requested breath or blood test complied with the applicable statutory process.
  • The supporting records: What the refusal advisement form, summons, police reports, body-camera footage, timing records, medical records, and testing documents show.

The reason a person declined or failed to complete a test is fact-sensitive. A request to consult a lawyer before testing isn’t automatically a reasonable basis for refusal, but the full interaction still matters.

More Than 75 Years of Combined DUI Experience

Michael Tillotson and Jeff Martin report more than 75 years of combined experience and thousands of handled DUI cases. Our attorneys have tried DUI cases across Virginia and taught other lawyers about legal and technical issues involving breath and blood testing.

This background allows us to examine the legal basis for the arrest alongside the mechanics and documentation of the requested test. Our published case results include a previous dismissal of a refusal charge, although past results don’t predict the outcome of another case.

What to Bring to Your Refusal Charge Review

Provide your charge papers, refusal form, court date, and any documents you received after the arrest. We’ll also need to know whether the officer requested a breath or blood sample, when the request occurred, and whether a medical or communication issue affected your response.

We evaluate the refusal allegation separately from the DUI charge while considering evidence relevant to both. A prompt review gives us time to identify applicable deadlines, investigate the testing procedure, and explain the potential effect on your driving privileges.
